CONTRACT

  • The photographic service will be performed according to the specific agreements reached with the Clients.

    In the absence of different written agreements, the service includes coverage for a maximum of 12 consecutive hours, typically concluding after the cake cutting or during the initial dances.

    The Photographer will determine the completion of the service based on the event's flow within the agreed timeframe. Any additional hour or fraction thereof beyond the 12th hour will be billed at €300/hour.

  • The total amount shall be paid as follows:

    • €500 as a "Caparra Confirmatoria" (pursuant to Art. 1385 of the Italian Civil Code), due upon signing to secure the date. This sum is non-refundable in case of client withdrawal, as it serves as a guarantee of the commitment.

    • The remaining balance is due no later than the day of the event (or a few days prior, as per the specific quote).

  • Statutory Right of Withdrawal: Pursuant to the Italian Consumer Code, the Clients may withdraw from this contract within 14 days of signing with a full refund of the deposit, provided the event date is not within this 14-day window.

    Subsequent Client Withdrawal: If the Clients cancel after the 14-day period, the following penalties apply as liquidated damages for the loss of business opportunity:

    • From day 15 until 60 days before the event: The Photographer retains the full Caparra Confirmatoria (€500).

    • From 59 to 20 days before the event: Penalty of 40% of the total agreed price.

    • From 19 days to the event date: Penalty of 60% of the total agreed price.

    Photographer Cancellation & Force Majeure: * If the Photographer cancels for reasons other than Force Majeure, they must return double the Caparra as per Art. 1385 c.c.

    In case of Force Majeure (documented illness, accident, or major impediments beyond control), the Photographer commits to providing a professional replacement of equal standing. If the Clients accept the substitute, the contract remains valid.

    If no replacement is found, the Photographer will refund all sums paid.

  • Portfolio Consent: The Clients grant the Photographer the right to use particularly meaningful images for promotional purposes (website, social media, contests).

    Pricing Structure: The agreed price includes a "Portfolio Discount" of €800.00. This discount is granted in exchange for the Clients' consent to the promotional use of the images.

    Privacy Option: Should the Clients wish to deny consent for any public use of their images, the "Portfolio Discount" will be waived, and the standard rate (total + €800.00) will apply.

    The Photographer commits to never using the images in a way that harms the Clients' image or reputation.

  • Intellectual Property: Pursuant to Italian Law 633/1941 and Supreme Court ruling no. 4094/1980, the Photographer remains the sole owner of the copyright and original files. The Clients are granted a license for private, non-commercial use.

    Vendor Sharing: The Clients are permitted to share the final post-produced images with their wedding vendors (e.g., Venue, Planner, Florist) for social media and website use, provided that:

    Integrity: The images are not altered (no filters, no changes to light, tones, or composition).

    Credit: The Photographer is clearly credited/tagged as the author in every publication.

    Digital Redemption: Clients may request the full buyout of high-resolution JPEG files for an additional fee of €500.00 (if not already included in the chosen package).

  • The Photographer will deliver a selection of post-produced images in high-resolution digital format.

    Client Responsibility: Upon delivery, the Clients must verify the files and create their own backups.

    Archive Policy: The Studio is authorized to delete the files from its archives 60 days after delivery.

  • Meals: The Clients agree to provide a hot meal for the Photographer and any assistant. To ensure no moments are missed, the meal should be served simultaneously with the guests' meal.

    Liability: The Clients agree to inform the Photographer of key people to be portrayed. Should guests cause damage to the Photographer’s equipment, the Clients will be responsible for the repair or replacement costs.

    Exclusivity: The Photographer shall be the sole professional photographer hired for the event.

    • This contract is governed by Italian Law. For anything not expressly provided for, the rules of the Civil Code apply.

    • The parties commit to an amicable resolution of any dispute. If this is not possible, the exclusive jurisdiction shall be the Court of Castellammare di Stabia, Italy.
